The 4-foot line — and the surcharge trap on a benched cut

In North Carolina the practical rule is simple: a retaining wall over 4 feet tall (bottom of footing to top of wall) generally needs an engineered design and a building permit; under 4 ft usually doesn’t. The catch is surcharge and terracing — and it’s common here, because a Pisgah-side bench often puts a driveway, parking pad, or building pad right on top of the wall that holds it.
